NOTICE OF PUBLIC HEARING PLANNING BOARD OF THE TOWNSHIP OF HILLSBOROUGH PLEASE TAKE NOTICE that on Thursday, June 6, 2024, at 7:00 p.m., the Planning Board of the Township of Hillsborough (“Board”) will hold a public hearing on the application (“Application”) of Toll Bros., Inc. (“Applicant”), at the Township of Hillsborough (“Township”) Municipal Complex Courtroom, 379 South Branch Road, Hillsborough, New Jersey 08844. The property, which is the subject of the Application is the Royce Brook Golf Club located at 201 Hamilton Road and is also known as Block 183, Lot 38.01 and Block 183.01, Lot 1 on the tax maps of the Township (“Property”). The Property totals approximately 435 acres and is located in the Royce Brook Planned Residential District (RBPRD). By resolution dated June 2, 2022, the Applicant was granted minor subdivision approval for the purpose of subdividing the existing Property into three (3) lots. That prior Application was referenced as 21-PB-10-S/MS/SP. On one of those 3 lots, the Applicant then received preliminary and final major subdivision to further subdivide a proposed 130.68 acre parcel for the purpose of developing a residential development that will consist of 174 single-family lots, six open space lots, stormwater management facilities, as well as interior roadways, walkways, underground utilities, landscaping and other supportive infrastructure (the “Residential Approval”). The remaining two lots from the minor subdivision, which comprised approximately 304 acres, did not propose any additional development and were retained within existing golf course uses. This present Application is for the purpose of extending the Residential Approval for an additional one (1) year pursuant to N.J.S.A. 40:55D-52d, which would extend the Approval date until June 2, 2025. The Applicant will also provide the Board an update as to the status of the minor subdivision approval previously granted (and thereafter extended) by the Board. The Applicant does not believe that any variances and/or waivers are required for the Application as the Application proposes no revisions to the approved plans for the Residential Approval. However, if upon further review by the Board and its professionals, the Application may be found to require additional variances, submission waivers, design waivers, exceptions and/or waivers from the requirements of the Township zoning code and/or the Residential Site Improvement Standards (“RSIS”) and/or other approvals as may be necessary to permit approval of the Application as submitted or with such changes as may be requested or accepted by the Board, this notice is to advise you that such additional variance and/or waiver relief may be requested by the Applicant at or prior to the time of the hearing. Copies of the maps and documents for which approval is sought are on file in the office of the above Board, located at the Municipal Complex, 379 South Branch Road, Hillsborough, New Jersey 08844, and are available for public inspection during regular business hours, Monday through Friday, holidays excepted. All parties in interest may appear at the public hearing and be heard concerning the Application and all matters pertaining thereto. By: Richard J. Hoff, Jr., Esq. HILLSBOROUGH TOWNSHIP ZONING BOARD OF ADJUSTMENT NOTICE OF HEARING TO WHOM IT MAY CONCERN: In compliance with the pertinent provisions of the Hillsborough Township Zoning and Land Development Ordinance, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned with the Hillsborough Township Zoning Board of Adjustment for relief pursuant to N.J.S.A. 40:55-52(a) to grant an extension of a previously-approved minor subdivision application (designated as Application BA-21-20) which was approved on March 15, 2023 and memorialized in a written resolution adopted by the Zoning Board on May 3, 2023. The prior subdivision approval permitted applicant to consolidate three existing lots and re-subdivide the lands into two new lots for the purpose of constructing a single-family home on each new lot. As a result of delays beyond the applicant’s control related to obtaining other governmental approvals associated with the minor subdivision, applicant was unable to record a subdivision deed within the time required by law and now seeks an extension of the previously-granted minor subdivision approval, together with an extension of any and all associated variances previously granted pursuant to N.J.S.A. 40:55D-70(c) and all waivers and/or other relief previously granted as part of the minor subdivision approval and/or as the Board may reasonably require in the exercise of its discretion to permit such extension. Applicant also was previously granted variance relief pursuant to N.J.S.A. 40:55D-70(d), however, those approvals remain valid and in good standing pursuant to Section 188-6(E) of the Hillsborough Township Zoning Code and no further relief or extension is required or sought regarding same. Applicant is not proposing any changes to the approved minor subdivision plan as part of this application. The aforementioned application and proposed development pertains to the property designated as Lots 44, 44.01 and 44.02 (formerly Lots 44, 44A and 44B) in Block 11 on the Hillsborough Township Tax Map, which property is located at Amwell Road and Mill Lane. Public hearing on the above-mentioned application has been scheduled for June 5, 2024, at 7:00 p.m. in the Courtroom of the Municipal Complex, Peter J. Biondi Municipal Building, 379 South Branch Road, Hillsborough, New Jersey 08844, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard. All documents relating to this application are available for inspection by the public at least ten (10) days in advance of the scheduled hearing date in the office of the Planning and Zoning Department, Peter J. Biondi Municipal Building, 379 South Branch Road, Hillsborough, New Jersey 08844, during regular business hours, which are Monday through Friday, 8:30 a.m. to 4:00 p.m. All documents and plans will also be posted online at the Township’s website: https://hillsboroughnj.civicclerk.com/. Please take further notice that the Board may, at is discretion, adjourn, postpone, or continue said hearing from time to time and you are hereby notified that you should make diligent inquiry of the Planning & Zoning Department concerning such adjournments, postponements, or continuations.
