THE BOROUGH OF HILLSBOROUGH LEGAL NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that the applicant, M&M at Camplain Road, LLC ("Applicant") has applied for Preliminary and Final Major Site plan approval to construct a multifamily housing development consisting of88 affordable units, including designated areas for storm water management, on land identified as Block 86, Lot 21.02 and located within the Sherman Redevelopment zone ( also known as Parcel B), enacted pursuant to and in furtherance of a Consent Order entered by the Superior Court ofN.J., docket #SOM-L-000900-15 on March 15, 2022. To the extent the Planning Board determines that relief from the ordinance sections set forth below are required, and are not superseded by the Township's duly adopted Redevelopment Plan, or are otherwise permitted by virtue of other provisions of the local ordinance, the applicant requests the following waiver or variance relief: 1. Stream Corridor relief from required compensation for detention basin and outfall (§ 188- 64. D(3)(C)) (waiver); 2. Stream Corridor relief from required compensation for road crossing (§188-64.D(3)(D)) (waiver); 3. Tree removal mitigation relief from number of required replacement trees (Section 188- 164.A) (waiver); 4. Relief from tree removal maximum of 20% whereas applicant seeks to clear 37% of the total tree count (188-163.B) (waiver or variance); 5. Relief from the requirement of two street connections to surrounding street network, whereas Applicant is proposing one access directly to Camplain Road and a second access for emergency purposes only to Jackson Street (Redevelopment Plan§ 3.5) (waiver); 6. Relief from the requirement of sidewalk access to external street networks, whereas Applicant is proposing none (Redevelopment Plan§ 3.4.3E) (waiver); and 7. Relief from the requirement to provide bike circulation through entire area (Redevelopment Plan§ 3.5) (waiver); 8. Relief from minimum building setback of 20 feet from internal street, whereas parking spaces are within 11.6 feet to 20 feet from buildings at various points throughout site (Redevelopment Plan§ 3.4.3) (waiver). As to request numbers 1 & 2, PLEASE NOTE that the Applicant has submitted an averaging plan, which is a permitted option under local ordinance section 188-64. (3)(B)[2], and which authorizes and permits such encroachments. As to request numbers 3 & 4, PLEASE NOTE that the adopted Redevelopment Plan (which may supersede the tree removal ordinance sections referenced therein) provides that no less than 60% of Redevelopment Parcel B shall be devoted to a contiguous, uninterrupted conservation and/or open space, and the application complies with this requirement, proposing 66% for such purposes. No other variances or waivers are required. The Applicant also requests such variances and/or waivers as the Planning Board or its staff and professionals may determine are necessary or appropriate during their review of the application, or as may be generated by changes to the plan required or suggested by members of the Planning Board, its consultants and/or members of the Public. A public hearing on this matter has been set for May 2, 2024, at 7:00 p.m. at the Hillsborough Township Municipal Building located at 379 South Branch Road, Hillsborough, NJ 08844, or as such date, time, and place to which the matter may be adjourned or carried. Any interested person may appear at the hearing either in person or by attorney, and be given an opportunity to be heard with respect to the approval sought by the applicant.
